At Counseling and Psychological Services (CAPS), we are committed to protecting your personal information and respecting your privacy. Feeling safe and comfortable sharing information is an essential part of the counseling process. The information you share with CAPS staff is protected by professional ethical standards and Nebraska state law. CAPS records are maintained separately and are not part of your academic record.
Age of Majority and Consent
In Nebraska, the age of majority for medical treatment is 19. However, under Nebraska law, individuals who are 18 years old may consent to their own mental health treatment. If you are under the age of 18, signed consent from a parent or legal guardian is required prior to receiving counseling services. A parent or guardian’s signature is also required for the release of information.
Information will not be released without your permission except under the following circumstances:
- Imminent threat of harm to yourself or others
- Suspected child or elder abuse
- Your written authorization
- A court-ordered subpoena
- Other specific legal circumstances
Mandatory Reporting and Nebraska Law
Nebraska mandatory reporting laws require the reporting of suspected child abuse, neglect, or sexual assault involving a minor.
