THE UNION'S CONTINUING DUTY TO BARGAIN WITH MANAGEMENT
Too many leaders in Nebraska do not fully understand the concept of the "continuing duty to bargain." Too many leaders falsely believe that the responsibility to bargain ends when the collective bargaining agreement (CBA) is signed.
Even when a valid contract is in effect, both Nebraska's Commission of Industrial Relations (CIR) and the National Labor Relations Board (NLRB) have consistently ruled that employers may not make unilateral decisions in wages, hours, and working conditions…even if the mandatory subject of bargaining is NOT specifically mentioned in the current CBA.
WHO SHOULD ATTEND:
This class addresses decisions made by the CIR and the NLRB. It is aimed at union leaders who are involved in processing grievances, but all interested union members will benefit from participating in the class.
WHAT YOU CAN EXPECT TO LEARN:
This class will explore the continuing duty to bargain over mandatory subjects of bargaining. It will detail how, when a valid CBA is in place, the union should respond if management makes a unilateral change without first coming to the union leadership to negotiate it.
Management rights clauses and the continuing duty to bargain after a CBA has been signed.
The role of the CIR and NLRB in enforcing a valid labor agreement.
The examination of Prohibited Practices under the CIR and Unfair Labor Practices under the NLRA as a remedy for management's unilateral changes in mandatory subjects of bargaining.
How to insure the union does NOT waive its right to grieve when management makes a unilateral change in a mandatory item of bargaining.
